Reporting and handling notices concerning allegedly illegal content

Reports must contain sufficient information to clearly identify the content concerned. Where applicable, please include the exact URL, domain name, IP address or affected service, a clear description of the reported content, the reasons why you consider the content to be illegal, the contact details of the reporting person or entity and any relevant supporting documents or information.

Upon receipt of a report, CHROOT may register and assess it. Depending on the information available, internal checks may be carried out, additional information or supporting documents may be requested, the affected service may be identified and the customer responsible for the reported service may be notified in order to obtain their position.

Reports are assessed individually, taking into account the information provided, the applicable legal framework, the nature of the affected service and CHROOT’s role as an intermediary service provider. The assessment of a report does not imply an obligation to adopt any particular measure and does not automatically result in the removal of content, restriction of access, suspension of the service or termination of the contractual relationship.

Once the assessment has been completed, CHROOT may adopt one or more proportionate measures, depending on the circumstances of the particular case. To the extent required or permitted by applicable law, the person or entity that submitted the report may be informed of the outcome of the assessment.

A report may be considered resolved once the assessment has been completed and a decision has been adopted. However, CHROOT may reassess the matter if new relevant information becomes available, a court decision is communicated, a competent authority issues a binding order or decision, or other circumstances arise that justify reopening the assessment.

Report handling procedure

  1. Receipt and registration of the report.
  2. Verification of the information provided and, where necessary, request for additional information or supporting documents.
  3. Identification of the affected service, domain name, IP address or customer.
  4. Assessment of the report in light of the applicable legislation and CHROOT’s role as an intermediary service provider.
  5. Where appropriate, notification of the customer concerned and request for their position.
  6. Adoption of such measures as are considered necessary and proportionate.
  7. Communication of the outcome, where required or permitted by applicable law.
  8. Reassessment where new relevant information becomes available or where a court decision or a binding measure issued by a competent authority is communicated.

Official communications from authorities

The contact point for authorities is intended for official communications submitted by competent authorities, including ANCOM, the European Commission, the European Board for Digital Services or other institutions acting within their legal powers.

Official requests should include, where applicable, the issuing authority, reference or case number, the legal basis relied upon, the affected service, domain name, URL or IP address, the requested action and the response deadline.

Role of the service provider

The services provided include web hosting, virtual servers, dedicated servers, colocation, domain registration and related services. Content hosted through these services is, in principle, provided and managed exclusively by the customers using the contracted services.

CHROOT acts as an intermediary service provider and does not exercise editorial control over the content published, transmitted or managed by its customers.

No general preventive monitoring of customer content is carried out. Reports are assessed individually, taking into account the information available, the applicable legal framework, the nature of the affected service and CHROOT’s role as an intermediary service provider.

Possible measures

Depending on the nature of the report, the seriousness of the situation, the risks identified and the information available, CHROOT may adopt one or more of the following measures:

  • request additional information or supporting documents;
  • identify the affected service, domain name, IP address or customer;
  • notify the customer responsible for the affected service and request their position;
  • request that the situation be remedied within a reasonable period of time;
  • temporarily restrict access to a service, domain name, IP address or other affected resources;
  • temporarily suspend the service;
  • terminate the service where permitted by applicable law or the applicable Terms and Conditions;
  • preserve data where required by law or pursuant to a valid legal request;
  • cooperate with competent authorities within the limits of the applicable legal obligations.

Any measures adopted are determined on a case-by-case basis. Not every report results in restrictive measures being taken.

Accepted languages

Communications submitted through the DSA contact points may be made in Romanian or English.

Limitations

The DSA contact channels are not intended for commercial enquiries, technical support requests, billing matters, the ordinary administration of contracted services or other requests falling outside the scope of Regulation (EU) 2022/2065 (Digital Services Act). For such matters, the standard departments available through the customer portal should be used.
